New Requirements for H-1B Visas

Dear Colleagues,

On September 19, 2025, the administration issued a Presidential Proclamation introducing new requirements that significantly impact certain H-1B visa holders and applicants. We write now to provide you with a summary of what this means for you as members of the Tulane community in H-1B status.

The proclamation does not appear to affect individuals who are already physically present in the US in H-1B status as of the effective date. Extensions, transfers, or changes of status for H-1B employees already in the US remain possible.

According to the proclamation, beginning September 21, 2025, H-1B visa applicants and beneficiaries outside the United States will not be issued an H-1B visa to enter the US unless their sponsoring employer pays a $100,000 entry fee per worker.

According to guidance, travel to the US with an H-1B visa issued prior to September 21, 2025, will remain possible, but this travel may present complications. We recommend consulting with us to discuss your individual risks before making any plans.  Policies are still evolving and we anticipate legal challenges.

If you are currently in the US in H-1B status: 

You are not subject to the entry ban. However, please exercise caution with international travel and reach out to OISS or to TULAP if you have questions about specific risks. 

If you are outside the US and planning to enter soon:

Please contact our office immediately.  Entry after September 21, 2025 may be delayed or denied unless your case qualifies for an exception, the requirements of which have not yet been articulated.
